Workers’ Compensation Benefits


Temporary Disability

Temporary disability benefits are paid to injured workers when they are not able to work temporarily. The rate for these benefits is two-thirds of your average weekly wage. These benefits are limited to 104 weeks total within five years from the date of your injury.

Permanent Disability

Permanent disability benefits are calculated based on the level of disability, which can range from zero to 100 percent. These benefits are paid weekly for a specific time, which depends on your level of disability. The maximum weekly rate is $290.

Medical Care

Under California workers’ compensation benefits, injured workers receive medical treatment for work-related injuries. However, you must be treated by a doctor approved in the special network. All medical treatment for these injuries is based on specific medical treatment guidelines, which determine the duration, frequency and appropriate type of treatment for claims.

Job Displacement Benefits

If you are not able to return to work in your previous field, you may be eligible for a $6,000 supplemental job displacement award voucher.

If the employer wishes to avoid receiving a voucher, they must offer you regular, alternate or modified work, which is at least 85 percent of your previous salary, lasts at least 12 months and is a reasonable commuting distance from your home. They must make these accommodations within 60 days of receiving the medical report from your physician that says your condition is permanent.

If an employer is not able to provide these accommodations, this voucher may be used towards placement and resume services, licensing and examination fees, computer equipment and tools for training programs.

Mileage Reimbursement

If you are injured, you are entitled to receive mileage reimbursement for any travel to and from all of your medical appointments or the pharmacy to pick up your prescriptions. Mileage reimbursement rates for 2020 are $0.575 per mile.  

Life Pension Benefits

If you have a disability rating that is between 70 to 99 percent, you qualify for a life pension. After receiving all your weekly payments for your disability, you will receive an additional amount for the rest of your life to help compensate for your higher level of permanent injury.

Death Benefits

Surviving depends or spouses that are killed while in the line of duty or conducting work-related activities are entitled to death benefits, which also includes burial expenses, up to $10,000. The amount of the death benefit can be viewed here.

Social Security Benefits


The Social Security Administration allows people to apply for retirement benefits if they are at least 61 years and eight months old.

Social Security Disability Benefits

Social Security will pay disability benefits to people that are unable to work due to a medical condition that is ongoing and expected to last or will result in death. Many times these claims get turned down, but an attorney can help assist you in filing the necessary paperwork so you can receive compensation for your disability.
